Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, landing pages, forms, scheduling tools, portals, messaging programs, calling programs, and other online or offline services that link to or reference these Terms (collectively, the "Services") provided by The Community Impact Fund ("CIF," "we," "us," or "our"), a 501(c)(3) nonprofit organization (EIN 82-4577516).

By accessing or using the Services, submitting a form, booking an Employer Impact Review, requesting information, or otherwise interacting with us through the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms cover the informational and scheduling Services offered through our website. Participation in any employer-funded Impact Loan program or financial coaching offering is governed by separate program terms and the parameters of the applicable fund; those separate terms control the loan relationship itself.

1. Eligibility and Authority

You represent that:

  • you are at least 18 years old, or you are using the Services under the supervision of a parent, guardian, or authorized representative;
  • any information you submit is truthful, accurate, and complete;
  • if you provide information about another person, you have the authority to do so;
  • if you provide a phone number or email address, you are the subscriber, customary user, or otherwise authorized to consent to communications at that contact point.

2. Scope of Services

The Services may allow you to:

  • learn about CIF, its mission, and its programs, including employer-funded Impact Loan programs and free financial coaching;
  • request information;
  • book a free Employer Impact Review or other consultation;
  • submit inquiries and other forms;
  • receive emails, text messages, calls, and related communications;
  • access certain third-party tools, forms, calendars, or scheduling systems.

The Services offered through our website are informational and scheduling Services only. They help employers learn about CIF and book a conversation, and help interested individuals reach us. Nothing on the Services is an offer of credit, and the website does not by itself enroll you in, approve, or fund any loan.

Impact Loans are charitable program disbursements

Impact Loans are charitable program disbursements offered through employer-funded programs and administered by CIF under applicable IRS regulations. They are not consumer credit products offered by the website. Participation, eligibility, disbursement, and repayment are governed by separate program terms and the parameters of the applicable fund. Submitting a form or booking an Impact Review does not guarantee loan approval, funding, or any specific outcome.

Nothing on the Services constitutes financial, legal, or tax advice, and nothing on the Services is a guarantee of loan approval, funding amount, program availability, or any other result.

3. Privacy and Communications Practices

Your use of the Services is also subject to our Privacy Policy, which is incorporated into these Terms by reference. In the event of a conflict between these Terms and the Privacy Policy as to privacy practices, the Privacy Policy will control with respect to those privacy issues.

By submitting information through the Services, you acknowledge that we may collect, use, and disclose personal information as described in our Privacy Policy.

4. Consent to Communications

By submitting a form, providing a phone number or email address, booking an Employer Impact Review, or otherwise requesting information from us, you give your express consent for CIF and its service providers to contact you regarding your inquiry and related CIF matters, including by calls and SMS or MMS text messages, including through automated technology, at the number and email address you provide.

Depending on the context and the permissions you provide, these communications may include:

  • responses to your inquiry;
  • Impact Review scheduling, confirmations, and reminders;
  • program information and follow-up;
  • administrative or account-related notices;
  • updates about CIF and its programs, where permitted and where you have provided any required consent;
  • operational or legally required notices.

These communications may be sent or placed by live agents or CIF personnel, by automated telephone dialing technology, and by SMS or MMS text messaging or email. CIF does not use AI-generated or prerecorded artificial voice calls and does not use ringless voicemail or direct-to-voicemail technology.

For telemarketing or promotional messages, prior express written consent is required; informational communications may be governed by different consent standards depending on the content and channel.

Consent is never required to participate

Consent to receive marketing or automated calls or texts is not a condition of purchase, enrollment, donation, or participation in any CIF program.

Automated chatbot. Our website may offer an automated chatbot to answer common questions and help you reach us. Responses may be generated by automated technology and are provided for general information only; they are not financial, legal, or tax advice and do not create any commitment by CIF. For anything important, please confirm with a CIF team member using the contact information below.

5. SMS, Calling, and Voicemail Program Terms

This section applies if you provide a mobile or other telephone number to us.

A. Program description

CIF may use your number to send or place communications relating to your inquiry, Impact Review scheduling and reminders, program information and follow-up, service or account notices, and optional updates about CIF where you have consented if required.

B. Use of automated technology

Where permitted by law and consistent with the consent you provide, CIF and its vendors may use automated dialing technology and automated SMS or MMS text messaging. CIF does not use prerecorded or artificial voice messages, AI-generated voice messages, or ringless or direct-to-voicemail technology. Live calls are placed by CIF personnel or authorized agents.

C. Consent standards

You agree that any consent you provide through a web form, checkbox, keyword, or other disclosed consent method may be used as evidence of your request and authorization to receive the communications you selected. Consent must be specific to CIF and the communication purpose presented at the time of collection.

D. Message frequency

Message frequency may vary. You may receive recurring communications depending on your relationship with CIF, your pending inquiry or booking, and the preferences you select.

E. Charges

Message and data rates may apply. Your mobile carrier's standard messaging or calling charges may apply.

F. Opt-out and help

You may opt out of text messages at any time by replying STOP. You may also use other standard opt-out keywords if supported, including STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. For help, reply HELP where supported, or contact us directly using the contact information listed below.

You may revoke consent to receive calls or texts by any reasonable method that clearly communicates your request. We will honor revocation and do-not-contact requests as required by law and, where applicable, within no more than 10 business days.

G. Effect of opt-out

If you opt out, we may still contact you for communications permitted by law, including certain non-marketing operational or legally required notices.

Mobile information sharing

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted.

We may use third-party messaging platforms to operate these programs.

H. No carrier liability

Wireless carriers are not liable for delayed or undelivered messages.

I. Number reassignment and accuracy

You agree to provide a valid number that you are authorized to use and to notify us promptly if your number changes. If your number is reassigned and another person receives messages intended for you, you agree to notify us so we can update our records.

J. Recording and logging

We and our service providers may log submissions, consent records, opt-ins, opt-outs, message events, and call events, and related metadata for compliance, fraud prevention, quality assurance, and dispute-resolution purposes.

6. Form Submissions and User Responsibilities

You agree not to:

  • submit false, misleading, or incomplete information;
  • impersonate another person;
  • submit another individual's phone number or email without proper authorization;
  • use the Services for unlawful, abusive, harassing, fraudulent, or disruptive purposes;
  • interfere with or attempt to gain unauthorized access to the Services or related systems;
  • upload malicious code or harmful content;
  • use the Services to send spam, exploit vulnerabilities, or evade opt-out controls.

We may reject submissions, suspend access, or block use of the Services if we believe these Terms have been violated or if needed to protect CIF, users, or third parties.

7. Intellectual Property

The Services, including their text, graphics, logos, images, videos, designs, layouts, compilations, and other content, are owned by or licensed to CIF and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial use related to learning about or interacting with CIF.

You may not:

  • copy, reproduce, republish, distribute, modify, display, or create derivative works from the Services except as expressly permitted by law or with our written permission;
  • use CIF's name, marks, or branding in a misleading way;
  • scrape, harvest, or systematically extract data from the Services without authorization.

8. Third-Party Services and Links

The Services may include links to or integrations with third-party websites and tools. These include, without limitation, HighLevel (GoHighLevel) for forms, scheduling, and messaging; Google Fonts for typography; our partnership with Giving Credit (givingcredit.org); and Candid/GuideStar for nonprofit transparency information.

We do not control and are not responsible for third-party services, their content, availability, or their privacy and security practices. Your use of third-party services is governed by their own terms and policies.

9. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. CIF disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

  • the Services will be uninterrupted, secure, or error-free;
  • forms, calendars, or integrations will always be available;
  • messages, calls, or emails will be successfully transmitted or received;
  • carrier delivery will occur on any particular timeline;
  • the Services will be free from delays, inaccuracies, or harmful components.

This disclaimer matters in messaging programs because carriers, device settings, filtering, network issues, and third-party platforms can affect delivery even where the sender has done everything right.

10. Limitation of Liability

To the fullest extent permitted by law, CIF and its affiliates, officers, directors, trustees, employees, volunteers, agents, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or use, arising out of or relating to the Services or these Terms, even if advised of the possibility of such damages.

To the fullest extent permitted by law, the total liability of CIF for claims arising out of or relating to the Services or these Terms will not exceed the greater of:

  • the amount you paid, if any, to use the specific Service giving rise to the claim; or
  • one hundred U.S. dollars ($100).

Some states do not allow certain limitations, so portions of this section may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless CIF and its affiliates, officers, directors, trustees, employees, volunteers, agents, and service providers from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

  • your use of the Services;
  • your violation of these Terms;
  • your violation of applicable law;
  • your submission of another person's information without authority;
  • your misuse of the communications program or consent process.

12. Suspension and Termination

We may suspend, restrict, or terminate your access to the Services, or stop communications to or from you, at any time and without prior notice if:

  • we believe you violated these Terms;
  • we need to protect the Services, users, or CIF;
  • required by law, regulation, carrier policy, or vendor requirements;
  • we discontinue a Service, program, or channel.

Termination does not affect rights or obligations that by their nature should survive, including consent records, dispute provisions, disclaimers, limitations of liability, and compliance logs.

13. Electronic Notices and Records

You agree that we may provide notices, disclosures, records, and other communications electronically, including by posting them on the Services, by email, by text message where appropriate, or by other electronic means permitted by law.

You agree that electronic records and signatures may have the same legal effect as paper records and handwritten signatures, to the extent permitted by law.

14. Geographic Scope

The Services are intended for use in the United States. We do not represent that the Services are appropriate or lawful for use outside the United States.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in the State of Colorado, and you consent to personal jurisdiction and venue there, unless applicable law requires otherwise.

16. Dispute Resolution

CIF encourages you to contact us directly to resolve any concerns before pursuing formal legal action. We are committed to addressing issues promptly and in good faith.

17. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date and may provide additional notice where required by law. Your continued use of the Services after updated Terms become effective constitutes acceptance of the revised Terms.
